In a significant stride towards safeguarding the rights of employees on pregnancy, maternity, adoption, or shared parental leave, the Protection from Redundancy (Pregnancy and Family Leave) Act 2023 is set to revolutionise workplace protections.

 

Current Protections: Currently, employees at risk of redundancy during maternity, adoption, or shared parental leave have the right to be offered any suitable alternative employment vacancy available. This protection ensures that individuals on maternity leave, for instance, are given the first refusal for suitable alternative employment without undergoing additional selection processes like interviews or scoring criteria. However, this protection ceases upon the employee’s return to work.

 

Extended Protections Under the Act: The Protection from Redundancy (Pregnancy and Family Leave) Act 2023 aims to extend these crucial protections, providing a more comprehensive shield for employees. The key provisions include:

  1. Pregnancy/Maternity Protection:
    • From the moment the employer is informed of the pregnancy.
    • Extending for 18 months after the expected week of birth or the exact date of the birth.
  2. Adoption Protection:
    • The protected period includes 18 months from placement for adoption.
  3. Shared Parental Leave Protection:
    • Extending for the period of 18 months from birth if six consecutive weeks of shared parental leave have been taken.

Clarifying Employer Responsibilities:

It’s important to note that this legislation doesn’t imply that employers cannot consider individuals on pregnancy, adoption, or shared parental leave for redundancy. Neither does it mandate the creation of new positions. Instead, during the protected period, these employees have the right to be offered suitable alternative employment in a redundancy situation.
