Navigating the Carer's Leave Act 2024

Identifying ‘Dependants’:

Dependants, according to the Carer’s Leave Act, include a spouse, civil partner, child, or parent living in the same household. Additionally, individuals reasonably relying on the employee for care support fall under this category.

Can Employers Refuse Carers Leave Requests?

While employers have the right to refuse carers leave requests if it would unduly disrupt business operations, employees have the option to reschedule the leave within one month of the original commencement date. Importantly, employees must not face any detrimental consequences for requesting time off, including dismissal, loss of hours or pay, promotion overlook, or disciplinary action.

Notice and Evidence Requirements:

Although it’s not specified how employees need to evidence care needs, it’s recommended to provide notice twice the amount of time they intend to take off. For instance, if a day off is needed to accompany a relative to a medical appointment, two days’ notice should be given.
